These Terms of Service govern your access to and use of stuckeysfriedchickennewport.site and any food, beverage or catering services you purchase from us. By placing an order, submitting an enquiry or using this website, you agree to be bound by these terms. If you do not agree, please do not use this website or place orders with us.

We are Stuckeys Fried Chicken Newport Pty Ltd, an Australian proprietary limited company trading as a fried chicken restaurant based in Newport, Victoria. Our Australian Business Number is ABN 96 702 576 814. References to "we", "us" and "our" in these terms mean the company; references to "you" mean our customers and website visitors.
3. Orders, pricing and payment
- All prices are displayed in Australian dollars (AUD) and include Goods and Services Tax (GST) where applicable.
- An order is an offer to purchase. A binding contract is formed when we accept your order, either by confirming it in writing or by preparing it for collection or delivery.
- We reserve the right to decline or cancel any order, including where items are unavailable, prices or promotions have been listed incorrectly, or we reasonably suspect fraudulent activity. Where we cancel a paid order, we will refund any amount you have paid.
- Payment must be made in full at the time of order or on collection or delivery, using the payment methods we accept.
- Quote requests submitted through our quote page are indicative only and do not constitute a confirmed booking until we confirm availability, menu and price with you in writing.
4. Food, allergens and dietary information
Our kitchen handles and prepares food that may contain or come into contact with common allergens, including gluten, nuts, shellfish, dairy, eggs and soy. While we take reasonable care, we cannot guarantee that any item is completely free of trace allergens. If you or anyone in your party has a food allergy or intolerance, please tell us before ordering so we can advise on suitable options. Descriptions of our food on this website are provided in good faith, but final preparation may vary.
5. Consumer guarantees under Australian law
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth), or any other applicable law that cannot lawfully be excluded.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. For goods, you are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
6. Refunds, replacements and cancellations
- If an item you receive is faulty, unsafe, not as described or otherwise fails a consumer guarantee, please contact us at ceo@stuckeysfriedchickennewport.site as soon as reasonably practicable so we can assess the issue and provide a replacement, repair or refund as appropriate under the Australian Consumer Law.
- Change-of-mind refunds for prepared food are provided at our discretion, having regard to the perishable nature of our products.
- Confirmed catering bookings may be cancelled or amended by contacting us. Cancellation fees may apply where staffing or ingredients have already been committed, and we will always inform you of any applicable fee in writing before it is charged.
7. Limitation of liability
To the fullest extent permitted by law, our total liability arising out of or in connection with any order or use of this website is limited, at our election, to the resupply of the relevant goods or services or the payment of the cost of resupply. Where the Australian Consumer Law does not permit such limitation, or where the goods or services are not ordinarily acquired for business purposes, this clause does not apply.
We are not liable for indirect, incidental or consequential loss, including loss of profits or enjoyment, except where such liability cannot lawfully be excluded. This clause does not affect your statutory rights under the Australian Consumer Law.
8. Use of this website and intellectual property
All content on this website, including text, images, logos and design, is owned by or licensed to Stuckeys Fried Chicken Newport Pty Ltd and is protected by Australian and international copyright and trade mark law. You may view and print pages for personal, non-commercial use only. You must not reproduce, republish or exploit our content commercially without our prior written consent, submit unlawful or misleading content through our forms, or attempt to interfere with the operation or security of this website.
We aim to keep the information on this website current and accurate, but we do not warrant that it will always be complete, error-free or uninterrupted. Menu items and availability may change without notice.

10. General provisions
- Governing law: These terms are governed by the laws of Victoria, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of Victoria.

- Entire agreement: These terms, together with any confirmed order or quote, form the entire agreement between you and us regarding the services.
- Events outside our control: We are not liable for delays or failures to perform caused by events reasonably beyond our control, including supply disruptions, severe weather or public health directives.
